Acceptable Use Policy
Terms and Agreements - SHARED HOSTING

This agreement will govern your purchase and use of any HostAbilities Services (collectively called "Plan(s)", your account will also be referred to as your "Plan(s)") as described in the Order Form, ordered by you and accepted by HostAbilities (also known as HostAbilities) and explains the terms and conditions that apply to your purchase and the use of the Plan(s). It is required that you register and accept this terms and conditions in order to use the Plan(s). By clicking the checkbox next to the text that reads "I have read, understood and accept the HostAbilities's Terms and Agreement" (also known as Acceptance Checkbox) you acknowledge that you have read this agreement and agree to be bound by the terms and conditions contained on this document as well as all policies and guidelines incorporated by reference. You agree that the act of submitting your order form online is equivalent to your signature. You agree that all the information you submit online is true and correct to the best of your knowledge.

  1. Disagreement. If you do not agree to the terms of this document, or any of HostAbilities's policies or guidelines, do not check the Acceptance Checkbox and your Plan(s) will not be created. If you do not agree to the terms of any modification to ANY HostAbilities document, immediately notify HostAbilities of your termination of this agreement, thereby terminating your Plan(s) with HostAbilities.
  2. Modification Agreement. HostAbilities reserves the right to change or modify any of the terms and conditions contained on this document and any policy or guideline incorporated by reference at any time. From time to time it is at HostAbilities reserves, in it's sole discretion, the right to determine whether and when any such changes apply to both existing or future customers. Any changes or modification will be effective upon posting to HostAbilities's website. HostAbilities will only post a notice of any revisions or changes to this document for thirty 30 days in the Control Panel of HostAbilities's website. HostAbilities may change or modify ANY policies or guidelines without notice to you. Your continued use of HostAbilities's Plan(s) will be the reflection of your cooperation and acceptance of any changes or modifications.
  3. Term. (i) 30 Days Terms - This agreement will be for the "term" of 30 days, beginning from the moment you register for the Plan(s). This agreement and your Plan(s) will be automatically renewed at the expiration of the term unless you followed the instructions described in the Termination Policy below. (ii) 12 or 24 Months Terms - This agreement will be for the "term" of twelve (12) or twenty-four (24) months, beginning from the moment you register for the Plan(s). This agreement and your Plan(s) will be automatically renewed at the expiration of the term unless you followed the instructions described in the Termination Policy below.
  4. Payment. All charges for your Plan(s) must be paid in advance according to the most current price of the Plan(s). Upon registration, you must pay for your Plan(s) by credit card or personal check. Upon paying for your Plan(s), you thereby grant permission to HostAbilities to charge any fees in accordance with your Plan(s). If you choose to pay by check, you authorize HostAbilities to automatically transfer money from your checking account, without invoice, via the transit and routing numbers you will supply or have supplied in the order form. If you pay by credit card, you must notify HostAbilities of any changes (including, but not limited to the, number, expiration, cancellation of your card, and your billing address) to your card that may prevent HostAbilities from billing you. Check / money orders can be sent on a as needed basis worked out with a Billing Manager. Check / money orders can not be refunded in addition the 30 Day-Money Back Guarantee does not apply to check orders.
  5. Charges. You will be charged additional nonrefundable fees in the event that you used excessive services including, without limitation, additional bandwidth, file transfer in excess of Plan(s) limits, or megabytes space. You agree to pay for any and all charges that may coincide with the usage of your Plan(s) at the then current HostAbilities prices, which shall be subject to any applicable taxes. You are responsible for the payment of all taxes of any nature including, without limitations, federal, state and local sales, use, value added, excise and duty taxes irrespective of which party may be responsible for collecting or reporting such taxes. You are only not liable for paying taxes on HostAbilities's income.
  6. Lateness. If your payment is received late, you may be responsible for paying a late charge of $10 per month for delayed payments. Your Plan(s) may remain suspended until payment is received by HostAbilities from you. If your Plan(s) is left unpaid for 60 days, your Plan(s) may be terminated. A termination under this condition, or any other, will not relieve you from paying any past due fees plus interest that have accrued prior to the termination. In the event of collection enforcement, you will be liable for any costs, including, without limitation, attorneys' fees, court costs, and collection agency fees. Plan(s) terminated or suspended and requested opened for file retrieval will result in requirement of a reconnection fee in the amount of $35 which will alolow the account to remain open for a period of no longer than 24 hours.
  7. 30 Day-Money Back Guarantee. You have a 30 day guarantee which will only apply to shared hosting Plan(s). If you do not feel HostAbilities has delivered the business you expected, you may terminate this agreement within the first 30 days from your initial order date, and receive a refund for the agreed upon monthly Plan(s) fee and shall exclude, without limitation, the refund of any or all setup fees, software purchases, or promotional discounts, etc... To receive the refund, you must terminate your Plan(s) in the manner described in the Termination Instructions below and discontinue your uses of the Plan(s), and HostAbilities must receive this notice within the first 10 day period of your Plan(s). You also agree to provide HostAbilities with a description of why you are not satisfied with HostAbilities's Plan(s). Checks or Money Orders can not be refunded with this policy. Further, if your account is suspended within your 30 Day Money-Back guarantee period, you are no longer elgible for a refund of any part of your money, which includes but is not limited to any setup fees, service fees or fees paid for annual billing terms. This policy does not apply to check or money order payment.
  8. Plan(s) Usage. The Acceptable Use Policy (also called AUP) dictate the general policies and procedures for the use of the Plan(s). HostAbilities's Online Privacy Statement informs the customer of how HostAbilities will collect, store, process and use the information associated with the use of your Plan(s). HostAbilities's Privacy Policy is located on HostAbilities's website and may be updated at any time. You should carefully read the AUP, as by registering for hosting you will be bound by the AUP and any modifications made to said document. HostAbilities reserves the right to terminate your Plan(s) without prior notice if you, in any way, should violate any part of the AUP or this Agreement.
  9. Content Requirement. Use of the Plan(s) requires a certain amount of knowledge in the use of Internet Programming Languages, protocols and software, etc... This knowledge will vary depending on the usage and content level of your website. You or your webmaster must have the knowledge necessary to maintain your website, as it is not HostAbilities's responsibility to advise, teach, supply or provide any such knowledge or customer support outside of the Plan(s) agreed to you by HostAbilities.
  10. Usage of allotted Resources. You agree that the use of the Plan(s) will not exceed the server resources (bandwidth, storage, e-mail usage, CPU) allotted to your Plan(s). If you use any resources that surpass the percentage or megabytes agreed upon, or if you exceed E-mail storage and attachment size limitations, HostAbilities may, in its sole discretion, apply additional charges, suspend the Plan's usage, or terminate this agreement. Attachment size limitations are set to a maximum of 10MB's (combined) for any outgoing mail. No shared hosting account is allowed to host scripts which consume more than 3% CPU and 7MB of memory per process. HostAbilities hosts production sites on production servers. Our servers are not to be used as a testing environment. Any website that causes downtime or heavy load on a server will be suspended without prior notification to you. Any site with traffic consisting more than 33% in file downloads (non HTML files) may be considered a WAREZ site and will be subject to immediate suspension without prior notice to you. In the event that HostAbilities elects to take corrective action, you will not be entitled compensation for any used or unused prepaid fees.
  11. Quality of Service. HostAbilities will make its best efforts to provide quality, and uninterrupted services but this is not a guarantee. HostAbilities will not be responsible for any damages caused by service interruption, temporary delay, or outages of the Plan(s).
  12. Employee Solicitation. You agree not to approach HostAbilities's employees with proposal to hire them as his own employees or contractors. If you were to hire any of HostAbilities's employee, you agree to pay HostAbilities for each employee the greater amount of three year's salary for that employee or $300,000.
  13. Limited Liabilities. Under no circumstances, including, without limitation, negligence or other tort, principles of contract, warranty, breach of any statutory duty, principles of indemnity or contribution, the failure of any limited or exclusive remedy to achieve its essential purpose or otherwise, shall HostAbilities in creating, producing or distributing the Plan(s) thereunder be liable to you for any indirect, special, consequential, incidental or exemplary damages including, without limitation, to damages for lost profits, loss of use, lost of data, errors, defects, phone bills, communication lines bills, loss of privacy, damages to third party even if HostAbilities has been advised of the possibility of such damages. In no event will HostAbilities or its suppliers have any liability for unauthorized access to, theft or destruction of any content made available for distribution by the Plan(s) through fraud or devices.
  14. Indemnification. You agree that you shall defend by counsel reasonably accepted by HostAbilities, protect and hold HostAbilities harmless from and against any and all demands, liabilities, losses, costs, expenses, claims, including reasonable attorneys' and consultants' fees and court costs, demands, causes of action, or judgment directly or indirectly arising out of or related to the Plan(s) provided HostAbilities to you.
  15. Disclaimer. You acknowledge and agree that HostAbilities accepts no responsibility or liability for, and employs no control over, the content of the information passing through HostAbilities's host servers, network hubs, or the Internet. All services performed thereunder are performed "as is" and without warranty against failure of performance including, without limiting to, any failure due to computer hardware or communication systems. Except as expressly provided in this Agreement, HostAbilities does not make and hereby disclaims, and you hereby waive all reliance on, any representations or warranties, arising by law or otherwise, in reference to the Plan(s), including, but without limiting to, implied warranties of merchantibility, fitness for a particular purpose, non-infringement, or developing from course of dealing, course of performance, or usage in trade.
  16. Automatic Plan(s) Upgrade. HostAbilities may automatically upgrade Plan(s) without notice if the prices for the same Plan(s) change for monthly Plan(s)
  17. Termination Instructions: To terminate your Plan(s) you must follow these instructions. Any other forms of termination will not be acceptable. You must provide HostAbilities with notice of a termination at least 7 days before the end of the Term by completing the form at http://www.HostAbilities.com/cancel/ . HostAbilities verifies the authenticity of the request with the account ID number only found inside the control panel accessable only to the owner of the account. Once we receive your Notice of Termination we will send you a confirmation e-mail. If your Plan(s) was billed in error after termination, credit will only be given to you if you have a valid confirmation e-mail. Any attempts to cancel by telephone voice messaging system will be rejected and billing will continue until these instructions have been followed. Any and all data and/or material placed by you to HostAbilities's equipment may be deleted upon termination. HostAbilities is not obligated to back-up any of this data and/or material after a Notice of Termination. If you reregister after your Plan(s) was made, any and all dues and fees paid up to date regardless of services rendered will be forfeited.
  18. Liabilities and Obligations on Termination. If the Agreement expires or is terminated for any reason, HostAbilities is not liable to you because of such an expiration or termination for compensation or reimbursement on Plan(s) of the loss of prospective profits, anticipated sales, goodwill or on Plan(s) of any investment, relation to, or association with your business or for any other reason resulting from your termination or expiration. Any termination of this Agreement will not deem you exempt from past due invoices or fees that have acquired prior to the termination of this Agreement owed by you to HostAbilities as provided in this Agreement. HostAbilities reserves the right to refuse service to anyone and terminate any Plan(s) without reason with 10 days notice.
  19. Violations. Failure to follow HostAbilities's Agreement, policies, guidelines (collectively called "Conditions") will result in cancellation of your Plan(s). HostAbilities will be the sole arbiter as to what constitutes a violation of the Conditions. HostAbilities reserves the right to remove any Plan(s) without prior notice. HostAbilities may investigate any reported violation of the Conditions or any complaints and take any action that it deems appropriate and reasonable to protect its systems, facilities, and/or third parties.
  20. Refund Policies. You and HostAbilities agree that there will be no monetary compensation for terminated Plan(s)/services services after the 30 day trial period, or once the account renews for another billing period regardless of the reason. No Refund or prorated. Setup Fees are non-refundable for any reason. Payment methods of check/moneyorder are non-refundable. Account cancellations within the trial period (first 30 days) of the account have 30 days to request the refund as stated in section 17 referring to section 7
  21. Promotions. Promotions through HostAbilities are subject to cancellation at anytime. HostAbilities has the right to revoke any promotional offer previously offered on an account should it not comply with the terms and conditions of the promotion. Promotional terms and rates do not apply to renewals of terms or accounts without limitation. Refunds offered by HostAbilities through any and all promotions can only be claimed within the first 30 days after the first date of issuance through the promotion. Any request for a promotion to be in-acted after the designated promotional period will be denied.
  22. Actions. HostAbilities reserves the right to restrict or remove any content from its equipment that violates the Conditions, or is objectionable, or infringing on any third party's rights or in potentially violation of any laws. In the event that HostAbilities becomes aware of the violation of the Conditions, a third party's rights or laws, HostAbilities may immediately take corrective action which may include, but not be limited to, (1) restricting the Plan(s), (2) suspending or terminating the Plan(s), (3) restricting or prohibiting any and all use of HostAbilities's equipment, and/or (4) pursue other civil remedies. The above stated rights however does not obligate HostAbilities to monitor or exert control over the information made available through the Plan(s). HostAbilities will not be obligated to refund you any fees or charges paid in advance for corrective actions due to possible violations of the Conditions.
  23. Disclosure. HostAbilities may reveal any information it deems necessary or appropriate, including, without limitation, user profile (e.g. name, e-mail address, etc...), usage history, material contained on HostAbilities's system in order to abide by any applicable laws, lawful governmental requests, to protect HostAbilities's systems and customers, or to provide and protect the quality, functionality, and integrity of HostAbilities's business and equipment. HostAbilities reserves the right to report any activities that it suspects violates any laws or regulations to the appropriate law enforcement officials, regulators or any other appropriate third parties.
  24. Compensation. You agree to compensate, HostAbilities and its affiliates and suppliers (and their respective employees, directors and representatives) for any and all expenses, including, without limitation, all claims, actions, proceedings, suits, liabilities, fines, and attorneys' fees, incurred by HostAbilities or it's suppliers, arising out of or relating to (1) your violation or breach of any agreement, terms, representation or warranty of this Agreement or any applicable policy or guideline; (2) your improper or illegal use of the Plan(s); or (3) your violation, alleged violation, or misappropriation of any intellectual property right (including, but not limited to, trademark, copyright, patent, trade secrets) or nonproprietary right of a third party.
  25. Uptime Guarantee. HostAbilities guarantees it's servers to be in operational order 99% of the year. This guarantee applies only to HostAbilities's network of servers. Reimbursement will not be issued if the cause of downtime is due to customer negligence of uploading techniques, improper DNS settings, Domain expiration, customer errors made in the control panel, backbone downtime, hardware failure or any other user error. Downtime compensation will be given if HostAbilities's server has been offline for a n extended period of time and deemed that compensation is authorized by the billing and support departments. Compensation will be for the portion of time that the server has experienced the lapse in service. If HostAbilities does not comply with the 99% uptime for the year, one month of service will be placed on the account. Direct instructions related to this compensation will be listed on our website.
  26. Entire Agreement. This agreement in addition with and to all policies and guidelines incorporated herein by reference, constitutes the entire agreement and contract between you and HostAbilities and supersedes any and all prior and contemporaneous, oral or written representations, communications, understandings and agreement between you and HostAbilities with respect to the subject matter hereof, all of which representations, communications, understandings and agreements are hereby canceled to the extent they are not specifically merged herein. You agree that you are entering into this entire agreement on the basis of any representations or promises not expressly contained in the entire agreement.
  27. Advertising. HostAbilities may, free of any obligation to compensation, payment or reward, use your name and refer to you as a client, in advertising, publicity, or similar materials distributed or displayed to current or prospective clients.
  28. Refusal of Service - HostAbilities reserves the right to refuse service to any customer at anytime regardless of reason.
  29. Laws. The entire agreement shall be governed by the laws of the United States and the state of Illinois and its validity constructions, interpretation and legal effect shall be governed by the laws and judicial decisions of the State of Illinois applicable to contracts entered into and performed entirely within the State of Illinois. You shall at all times accord with all applicable laws and regulations and shall protect and save HostAbilities harmless from your failure to stray from accordance. You agree that HostAbilities shall not have to perform any obligations set forth in this Agreement if such performance would violate any present or future law, regulation or policy of any applicable government. You shall not use the Plan(s) in any way that violates U.S. export laws, including without limitation, uses related to the distribution of weapons of mass destruction, prohibited chemical, biological, or nuclear weapons or missile use. You agree that you are not located in, under control of, or a national or resident of any country restricted as a destination by U.S. law or on the US Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce's Table of Denial Orders.
  30. Severability. If any provisions of the entire agreement shall be unlawful, void, or for any reason, unenforceable, it shall be deemed severable form and shall in no way affect the validity or enforceability of, the remaining provisions of the entire agreement, which shall remain valid and enforceable according to its terms. If it is deemed severable form, the liability of HostAbilities and its suppliers to you will be limited to the amount actually paid to HostAbilities by you under this agreement during the three (3) months preceding the date on which the claim accumulated. This limitation applies to all causes of action in the aggregate including, but not limiting, to breach of contract, breach of warranty, negligence, strict liability, misrepresentations, and other damages. The fees for the Plan(s) set by HostAbilities have been and will continue to be based upon this allocation risk. Accordingly, you hereby release HostAbilities and its suppliers from any and all obligations, liabilities, and claim beyond the limitation stated in this section
  31. Warranties and Representation. You warrant and represent to HostAbilities that you are (1) at least eighteen 18 years of age; (2) you possess the legal right and ability to enter this agreement; (3) you will use the Plan(s) only for lawful purposes and remain in accordance with this Agreement and all policies and guidelines that may apply; (4) you will be financially responsible for your Plan(s); (5) you have acquired, or will acquire all necessary arrangements for hypertext links to a third party Web sites or other content; (6) you have verified or will verify the accuracy of materials distributed or made available through use of the Plan(s), including, without limitation, your content, claims, warranties, guarantees, nature of business, and address where business is conducted, and (7) your content does not infringe or violate any right of any third party (including intellectual property rights) or violate any applicable law, regulation or ordinance.
  32. Acceptable Use Policy

    As a provider of Internet access, web site hosting, and other Internet-related services, Hostabilities.com offers its customers (also known as subscribers), and their customers and users, the means to acquire and disseminate a wealth of public, private, commercial, and non-commercial information. Hostabilities.com respects that the Internet provides a forum for free and open discussion and dissemination of information, however, when there are competing interests at issue, Hostabilities.com reserves the right to take certain preventative or corrective actions. In order to protect these competing interests, Hostabilities.com has developed an Acceptable Use Policy ("AUP"), which supplements and explains certain terms of each customer's respective service agreement and is intended as a guide to the customer's rights and obligations when utilizing Hostabilities.com's services. This AUP will be revised from time to time. A customer's use of Hostabilities.com's services after changes to the AUP are posted on Hostabilities.com's web site, www.Hostabilities.com, will constitute the customer's acceptance of any new or additional terms of the AUP that result from those changes.

    One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet's openness and value, but it also places a high premium on the judgment and responsibility of those who use the Internet, both in the information they acquire and in the information they disseminate to others. When subscribers obtain information through the Internet, they must keep in mind that Hostabilities.com cannot monitor, verify, warrant, or vouch for the accuracy and quality of the information that subscribers may acquire. For this reason, the subscriber must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet is sexually explicit or otherwise offensive. Because Hostabilities.com cannot monitor or censor the Internet, and will not attempt to do so, Hostabilities.com cannot accept any responsibility for injury to its subscribers that results from inaccurate, unsuitable, offensive, or illegal Internet communications.

    When subscribers disseminate information through the Internet, they also must keep in mind that Hostabilities.com does not review, edit, censor, or take responsibility for any information its subscribers may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation, and other harmful speech. Also, because the information they create is carried over Hostabilities.com's network and may reach a large number of people, including both subscribers and nonsubscribers of Hostabilities.com, subscribers' postings to the Internet may affect other subscribers and may harm Hostabilities.com's goodwill, business reputation, and operations. For these reasons, subscribers violate Hostabilities.com policy and the service agreement when they, their customers, affiliates, or subsidiaries engage in the following prohibited activities:

    Spamming -- Sending unsolicited bulk and/or commercial messages over the Internet (known as "spamming"). It is not only harmful because of its negative impact on consumer attitudes toward Hostabilities.com, but also because it can overload Hostabilities.com's network and disrupt service to Hostabilities.com subscribers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, Hostabilities.com has the discretion to determine from all of the evidence whether the email recipients were from an "opt-in" email list.

    Intellectual Property Violations -- Engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities. Also, engaging in activity that violates privacy, publicity, or other personal rights of others. Hostabilities.com is required by law to remove or block access to customer content upon receipt of a proper notice of copyright infringement. It is also Hostabilities.com's policy to terminate the privileges of customers who commit repeat violations of copyright laws.

    Obscene Speech or Materials -- Using Hostabilities.com's network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material. Hostabilities.com is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through Hostabilities.com's network.

    Defamatory or Abusive Language -- Using Hostabilities.com's network as a means to transmit or post defamatory, harassing, abusive, or threatening language.

    Forging of Headers -- Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.

    Unsolicited commercial email/Unsolicited bulk email -- Using the Services to transmit any unsolicited commercial email or unsolicited bulk email. Activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email whether or not that email is commercial in nature, are prohibited.

    Illegal or Unauthorized Access to Other Computers or Networks -- Accessing illegally or without authorization computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity).

    Distribution of Internet Viruses, Worms, Trojan Horses, or Other Destructive Activities -- Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mailbombing, or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service, or equipment.

    Facilitating a Violation of this AUP -- Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mailbombing, denial of service attacks, and piracy of software.

    Copyright or trademark infringement -- Using the Services to transmit any material (by email, uploading, posting, or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software. EarthLink is registered under the Digital Millennium Copyright Act of 1998.

    Collection of personal data -- Using the Services to collect, or attempt to collect, personal information about third parties without their knowledge or consent.

    Export Control Violations -- Exporting encryption software over the Internet or otherwise, to points outside the United States.

    Usenet Groups -- Hostabilities.com reserves the right not to accept postings from newsgroups where we have actual knowledge that the content of the newsgroup violates the AUP.

    Other Illegal Activities -- Engaging in activities that are determined to be illegal, including advertising, transmitting, or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards, and pirating software.

    Other Activities -- Engaging in activities, whether lawful or unlawful, that Hostabilities.com determines to be harmful to its subscribers, operations, reputation, goodwill, or customer relations.

    As we have pointed out, the responsibility for avoiding the harmful activities just described rests primarily with the subscriber. Hostabilities.com will not, as an ordinary practice, monitor the communications of its subscribers to ensure that they comply with Hostabilities.com policy or applicable law. When Hostabilities.com becomes aware of harmful activities, however, it may take any action to stop the harmful activity, including but not limited to, removing information, shutting down a web site, implementing screening software designed to block offending transmissions, denying access to the Internet, or take any other action it deems appropriate.

    Hostabilities.com also is aware that many of its subscribers are, themselves, providers of Internet services, and that information reaching Hostabilities.com's facilities from those subscribers may have originated from a customer of the subscriber or from another third-party. Hostabilities.com does not require its subscribers who offer Internet services to monitor or censor transmissions or web sites created by customers of its subscribers. Hostabilities.com has the right to directly take action against a customer of a subscriber. Also, Hostabilities.com may take action against the Hostabilities.com subscriber because of activities of a customer of the subscriber, even though the action may effect other customers of the subscriber. Similarly, Hostabilities.com anticipates that subscribers who offer Internet services will cooperate with Hostabilities.com in any corrective or preventive action that Hostabilities.com deems necessary. Failure to cooperate with such corrective or preventive measures is a violation of Hostabilities.com policy.

    Hostabilities.com also is concerned with the privacy of on-line communications and web sites. In general, the Internet is neither more nor less secure than other means of communication, including mail, facsimile, and voice telephone service, all of which can be intercepted and otherwise compromised. As a matter of prudence, however, Hostabilities.com urges its subscribers to assume that all of their on-line communications are insecure. Hostabilities.com cannot take any responsibility for the security of information transmitted over Hostabilities.com's facilities.

    Hostabilities.com will not intentionally monitor private electronic mail messages sent or received by its subscribers unless required to do so by law, governmental authority, or when public safety is at stake. Hostabilities.com may, however, monitor its service electronically to determine that its facilities are operating satisfactorily. Also, Hostabilities.com may disclose information, including but not limited to, information concerning a subscriber, a transmission made using our network, or a web site, in order to comply with a court order, subpoena, summons, discovery request, warrant, statute, regulation, or governmental request. Hostabilities.com assumes no obligation to inform the subscriber that subscriber information has been provided and in some cases may be prohibited by law from giving such notice. Finally, Hostabilities.com may disclose subscriber information or information transmitted over its network where necessary to protect Hostabilities.com and others from harm, or where such disclosure is necessary to the proper operation of the system.

    Hostabilities.com expects that its subscribers who provide Internet services to others will comply fully with all applicable laws concerning the privacy of on-line communications. A subscriber's failure to comply with those laws will violate Hostabilities.com policy. Finally, Hostabilities.com wishes to emphasize that in acknowledging the on-line service agreement, subscribers indemnify Hostabilities.com for any violation of the service agreement, law, or Hostabilities.com policy, that results in loss to Hostabilities.com or the bringing of any claim against Hostabilities.com by any third-party. This means that if Hostabilities.com is sued because of a subscriber's or customer of a subscriber's activity, the subscriber will pay any damages awarded against Hostabilities.com, plus costs and reasonable attorneys' fees.

    We hope this AUP is helpful in clarifying the obligations of Internet users, including Hostabilities.com and its subscribers, as responsible members of the Internet. Any complaints about a subscriber's violation of this AUP should be sent to abuse@hostabilities.com.
